Terms of Service
1. Agreement and Provider
These Terms govern FixForAI services provided by OmniAgent llc, 30 N Gould St Ste R, Sheridan, WY 82801, United States. By ordering or using the service, you confirm that you have authority to act for the restaurant or business.
2. Service Scope
FixForAI provides restaurant AI-visibility deliverables limited to website analysis, llms.txt generation and delivery, schema markup generation or injection, AI Summary Page work where included in the selected plan, and relevant update monitoring for care-plan customers. We do not control search engines or AI systems and do not guarantee rankings, citations, recommendations, traffic, bookings, or revenue.
3. Delivery Options
Plan prices cover self-install delivery: we send the files and deployment instructions. Optional human deployment may be purchased separately for $99 per deployment or $499 for a bundle of ten deployments. Human deployment does not require a subscription. The customer must provide authorized, minimum-necessary access and remains responsible for revoking or rotating access when appropriate.
4. Delivery Timing
We aim to deliver the agreed self-install files within 48 hours after receiving the required information and access. The 48-hour period pauses while required information or access is missing, inaccurate, or late. The guarantee covers initial delivery of the agreed files and instructions; later monitoring changes and human-deployment requests receive the timing confirmed for that work.
5. Plans and Payment
- Standard one-time setup: $99.
- Standard Monthly Care: $199/month.
- Standard Yearly Care: $599/year.
- Founder one-time setup: $49.
- Founder Monthly Care: $99/month.
- Founder Yearly Care: $299/year.
- Human deployment: $99 each or $499 for ten.
Payments are processed by the configured payment provider. FixForAI does not store full card numbers. Founder pricing remains locked while the applicable subscription remains continuously active; a later restart uses then-current pricing.
6. Cancellation and Refunds
Monthly and yearly care plans may be cancelled at any time; service continues through the current paid period where practical. Payments are non-refundable after agreed delivery, including yearly plans, except where FixForAI fails to deliver the agreed service or a refund is required by applicable law. No refund is due for deliverables already provided, subject to applicable law.
7. Customer Responsibilities
- Provide accurate restaurant information and authorized website content.
- Ensure you have rights to menus, hours, logos, photos, trademarks, and other supplied content.
- Provide access only when choosing human deployment and maintain control of your credentials.
- Review self-install instructions and notify us of material changes or errors.
- Do not use FixForAI or its deliverables for unlawful, deceptive, abusive, harmful, infringing, or unauthorized activity.
8. Ownership and Use
After full payment, you receive a permanent, non-transferable right to use the agreed deliverables for the restaurant website originally purchased. FixForAI retains ownership of its tools, templates, scoring systems, methods, and internal processes. You may not resell or sublicense the deliverables for another business or website without written permission.
9. Corrections and Limitations
If FixForAI publishes materially incorrect customer information or makes an unauthorized change through its own deployment work, we will use reasonable efforts to correct it at no additional charge. The service depends on your website, CMS, hosting, public data, and third-party services. We are not responsible for later customer edits, outages, hacking, malware, hosting failures, CMS changes, or changes made by AI/search providers outside our control.
To the maximum extent permitted by law, total liability for a claim is limited to the amounts paid for the affected service during the 12 months before the event giving rise to the claim. This does not limit liability that cannot legally be limited.
10. Suspension and Termination
We may suspend or terminate service where necessary to address urgent harm, security risk, legal exposure, abuse, or non-payment. For ordinary violations, we will provide notice and a reasonable opportunity to correct where practical. Termination does not remove obligations already incurred or rights required by law.
11. Governing Law
These Terms are governed by Wyoming law, subject to mandatory law that gives a customer another forum or prevents a contractual venue requirement. Disputes will be handled in an appropriate Wyoming state or federal court unless applicable law requires otherwise.
